Common questions

How does a divorce by mutual consent work?

Both spouses file a joint petition in the Family Court stating that they have been living separately for the required period and have agreed on all terms, including maintenance and custody. After the first motion there is a waiting period of up to six months, which the court may waive in suitable cases, and the decree is passed on the second motion.

Who gets custody of the children?

Courts decide custody on the welfare of the child rather than the rights of either parent, weighing age, schooling, the child’s own wishes where old enough and each parent’s circumstances. The other parent is usually given visitation. We help you present the arrangement that serves your child best.

Can I claim maintenance while the case is pending?

Yes. Interim maintenance can be sought from the Family Court during the proceedings, and separately under the BNSS or the Protection of Women from Domestic Violence Act. The amount depends on the income and needs of both spouses and the standard of living during the marriage.

Will my matter stay private?

Everything you tell us is confidential. Family Court proceedings may be held in camera where the law provides or the court directs, and we prepare you for each hearing so that you know what to expect.
